Though the UTP is not a political party, as a think tank we have advocated a number of positions and addressed a number of issues we consider to be important. So enough of idle chatter: the following in the text of a bill we would propose today if we held a seat in the Chamber of Deputies. Hopefully this will give our representatives something to actually discuss.

Note, I would certainly be open to “amendments.” I am not one of those “my way or the highway” type of people. I do not believe that my vision of the bill is the only allowable version. The ability to not attach your ego to your ideas is a prerequisite for intelligent thought. I am not perfect in this but it is something for which I strive.

TITLE

An Act to Recognize the Legal Status of Marriage between Consenting Adults

PREAMBLE

Whereas the freedom to love and legally unite with whomever we choose is an essential and inalienable right of full citizenship and a number of our citizens may find it impossible to attain this status in their nations of residence due to issues of racism, homophobia, classism or some other ethical misconception of the local body politic, and the freedom to enter into relationships with whomever the citizen may is a key feature of the Talossan Republic and must be to act as a beacon of real decency and democratic values, The Government of the Republic of Talossa enacts this law.

DEFINITION

1. The Government of the Republic of Talossa (henceforth, The Government) shall recognize as a state of marriage any legal, contractual union between consenting adults, entered into voluntarily by any Talossan citizen and any other person that is defined as marriage or a civil union in their nation of origin.

2. The Government shall grant full legal recognition and define as marriage any social, personal union between a citizen, who is of the age of majority in their country of origin and is unable to legally unite with their chosen partner, who is also of the age of majority in their nation of origin.

3. This Act defines the term “marriage” for use by the Government. No religious body or official may be forced to officiate at any ceremony marking this legal, contractual event. No religious ceremony may be required to complete this legal process.

4. No definition of marriage shall be predicated on issues of race, class, physical impairment, sexual orientation or gender.

5. No benefit of marriage accorded by The Government to its citizens may be differentiated by race, class, physical impairment, sexual orientation or gender.

PROCESS

1. The Office of the Secretary of State or authorized representative thereof shall have the power to issue Marriage Certificates.

2. A Marriage Certificate must be issued on the request of any citizen of Talossa who may prove any of the definitions of marriage as listed in this act.

3. The Office of the Secretary of State may charge a fee for the issuance of the certificate of no more that cost of production, plus a surcharge of 15% and shipping and handling. All funds gained by this process, if any, are to be considered general funds and are under the administrative control of The Government.

DIVORCE AND ANNULMENT

1. Any decree of divorce recognized by a citizen’s nation of residence must be recognized by the Republic of Talossa.

2. Any state of marriage entered into solely under to authority of The Government may be terminated automatically 30 days after the request of one or both of the parties of the marriage contract.

3. An annulment, legally defined as a termination of a marriage as if it did not exist, is automatically granted at the request of either party within 30 day of the marriage.

4. It is the responsibility of the parties involved in a procedure of divorce or annulment to inform the Secretary of State of their change in status.

DATE OF EFFICACY

1. This date shall take affect no more than 60 days after is acceptance into law.
