No, the constitution guarantees that no discrimination against anyone (including on teh basis of sexual orientation) is legal. And since marriage is a protected right, then why worry about spelling it out specifically?
Of course, if your desire is simply to have a certificate-issuing authority (so our document fetishists can have fun), then try to limit the bill to just that.
