Members of the PGC,

Below is a bill to set into law the immigration process. The bill is based on the procedure developed by Immigration Minister Andy Lowry, and is designed to allow us to naturalize new citizens before we have our constitution in place. Please look it over and vote on it. Provisional Secretary Ragsdale, please feel free to assign the appropriate resolution number to this bill.

Immigration is, in my opinion, currently our highest priority, so a timely up or down on this bill will be helpful. Here are the rules for this vote:

1. The vote will commence immediately and voting will be permitted until 3pm Talossan Standard Time, Wednesday, June 23, 2004.

2. The bill will be considered passed if it receives seven PER votes on or before the end of the voting period. Date and time of passage shall be the date and time of the seventh PER vote.

3. The bill will be considered passed if it receives a simple majority of all votes cast by the end of the voting period, as long as a quorum of at least four votes has been received.

4. If neither condition is met, the bill will be considered rejected.


Without further ado, I hereby present the OMNIBUS IMMIGRATION ACT

OMNIBUS IMMIGRATION ACT

WHEREAS an orderly immigration procedure is essential for the continued growth and success of the Republic, and

WHEREAS the following procedures have been proposed by the Provisional Minister of Immigration, and

WITH the understanding that this law is a provisional one, which can and will be superseded by the adoption of a permanent constitution and subsequent adoption of a permanent immigration code,

THEREFORE, the following procedures will be adopted into law to allow for the naturalization of immigrants until such time as it is superseded by new legislation under the permanent constitution.

1. The following procedures shall apply to individuals who are currently citizens of the Kingdom of Talossa. They shall also apply to anyone who publicly renounced their citizenship from the Kingdom of Talossa with the intent of joining the Republic between June 16, 2004 and the date of passage of this bill.

a. Before applying for citizenship in the Republic, the prospective must publicly renounce his or her citizenship in the Kingdom of Talossa.

b. The prospective must submit contact information to the Ministry of Immigration. This contact information shall consist of mailing address, email and phone number. The Minister of Immigration shall be responsible for ensuring all such information is strictly confidential and will never be given to anyone without the prospective's permission.

c. After receiving the contact information, the Minister of Immigration shall ensure that a Wittenberg account is established for the new prospective.

d. The prospective shall submit a photocopy or digital scan of a valid photo ID to the Ministry of Immigration. (The Minister of Immigration shall be empowered to determine what constitutes valid photo ID.) The Minister of Immigration shall be responsible for ensuring that this is also strictly confidential, in the same manner as the contact information in sub-paragraph 1.b.

e. When the preceding steps have been fulfilled, the prospective citizen shall be entitled to request a vote from the Provisional Governing Council. The Provisional Governing Council shall then hold a public vote on the prospective at the earliest available opportunity.

2. The following procedures shall apply to individuals who are currently citizens of the Kingdom of Talossa, and would like to participate as a "Friend of the Republic".

a. Individuals who are eligible to become Talossan citizens shall be eligible to request Wittenberg access on a probational basis. Such access shall be granted or denied by the Minister of Immigration at his discretion. If access is denied the Minister much publicly disclose that fact, unless the applicant requests otherwise, in which case the Minister shall inform the Dean of the Provisional Governing Council.

b. “Friends of the Republic" may remain in this status without applying for citizenship indefinitely, and may choose to remain anonymous.

c. The Provisional Governing Council shall have the right to revoke "Friend of the Republic" status from anyone at any time for any reason. Revocation shall be by public vote.

d. Once a "Friend of the Republic" applies for citizenship, he or she shall be subject to the normal rules.

3. The following procedures shall apply to those who are not current citizens of the Kingdom of Talossa.

a. The prospective must submit a contact-information form. The Minister of Immigration shall be responsible for creating this form, and for supplying it to the prospective upon request. The Minister of Immigration shall be responsible for ensuring that the information on the form is strictly confidential, in the same manner as the contact information in sub-paragraph 1.b.

b. When the contact information form is submitted, the Minister of Immigration shall ensure that a Wittenberg account is established for the new prospective.

d. The prospective shall submit a photocopy or digital scan of a valid photo ID to the Ministry of Immigration. (The Minister of Immigration shall be empowered to determine what constitutes valid photo ID.) The Minister of Immigration shall be responsible for ensuring that this is also strictly confidential, in the same manner as the contact information in sub-paragraph 1.b.

e. The prospective shall be required to submit a brief biography, which shall be made publicly available.

f. The prospective shall be required to write an essay on the topic "What Talossa Means to Me". This essay may be humorous, serious, a combination of the two, or even surreal, at the discretion of the prospective. This essay shall be made publicly available.

g. When the preceding steps have been fulfilled, the prospective citizen shall be entitled to request a vote from the Provisional Governing Council. The Provisional Governing Council shall then hold a public vote on the prospective at the earliest available opportunity.

h. The Provisional High Court shall be entitled to ask questions of the prospective citizen and to make a recommendation to the Provisional Governing Council. The Court may choose to exercise this option at any stage in the process.

4. Anyone who is a prospective citizen with a Wittenberg account on the date of passage of this bill shall, at the discretion of the Minister of Immigration, be allowed to maintain their account even if the steps required before an account may be created have not been fulfilled, as long as those steps are fulfilled in a timely manner. (The Minister of Immigration shall be empowered to determine what constitutes a timely manner.)
